Why is this proposal being advertised?

    Amendments to Class ‘A’ Reserves are required to be tabled in both Houses of Parliament. Before this can occur, the proposed amendments are required to be publicly advertised as per sections 42(5) and 44(2) of the Land Administration Act 1997.

    What is the role of Department of Planning, Lands and Heritage (the Department) in this project?

    The Department administers the Land Administration Act 1997 (LAA), which is the legislation that provides for the City of Mandurah to manage the site. The City have proposed the excision of a portion of the site which is a process that is outlined in the LAA.

    When will this proposal be determined?

    Comments will be accepted within 30 days of the date of the advertisement. 

    At the conclusion of those 30 days, the submissions will be considered and a briefing provided to the Minister for Lands to inform the proposal being tabled in both Houses of Parliament.

    Has there been any previous community consultation on this proposal?

    Yes – the City have previously consulted as per requirements of the Local Government Act 1995.

    What consideration has been given to Aboriginal Heritage?

    Registered Aboriginal sites 3724 and 32696 on Leighton Place, Halls Head were assessed by the former Aboriginal Cultural Material Committee (ACMC) as meeting the criteria for a site under section 5 of the Aboriginal Heritage Act 1972. Based on information currently held by the Department, the City of Mandurah has been advised that their proposed Western Foreshore works do not intersect either of these two Halls Head sites.

    What engagement has been undertaken with Traditional Owners on this proposal?

    The City of Mandurah have engaged with the Winjan Aboriginal Corporation since early 2023, and more recently with the Gnaala Karla Booja Aboriginal Corporation. The City will be engaging further with both parties as the project progresses.

    What are the elements of the proposal that I can influence?

    This consultation is related specifically to the proposed excision of the 8000m2 site from Reserve 27581. Comments are sought from the community specifically on the merits of the excision.

    What is the process for this proposal to be determined?

    Following the conclusion of the advertising period, submissions will be considered and a summary provided to the Minister for Lands. The Minister for Lands will consider the proposal, and if appropriate, approve its tabling in Parliament. Should the tabling proceed and no motions of disallowance pass in either House, the proposal may be implemented. The sub-lease and development will still be subject to separate approvals processes.

    Will my submission be shared with the City of Mandurah?

    As the City of Mandurah is the proponent, queries that are specifically related to aspects of the broader proposal outside of the proposed excision may be referred to the City to address.
