Why is the application being re-advertised?

    Following the Department’s preliminary assessment of the proposal, which took into account comments received in December 2024 and January 2025 from the City of Busselton, State agencies and the public, as well as design advice, the applicant submitted revised plans for consideration by the Western Australian Planning Commission (WAPC). 

    The revised plans received on 9 July 2025 detailed the inclusion of the land use ‘Trade Supplies’, which is a use not permitted (‘X’ use) on the site. Determination of this land use requires the WAPC to exercise its additional discretion under s.171R of the Planning and Development Act 2005 (PD Act), as the use is not approvable under the local planning framework.

    As public consultation is an important component of our planning system, readvertising of the proposal is being undertaken to offer members of the public the chance to provide comment on the proposed ‘Trade Supplies’ land use.  

    What is different about the application?

    With the exception of the additional land use, the revised proposal is otherwise broadly consistent with the plans advertised in December 2024-January 2025. Some modifications to the plans have occurred elsewhere, for example in relation to vehicle access, landscaping and parking, and these changes were undertaken in response to the issues raised during the initial advertising.

    Since these elements are not considered major revisions, feedback is best limited to the additional land use only.

    Why has the developer already started works on site?

    Earthworks currently under way on site are associated with a conditional subdivision approval issued by the WAPC in July 2025. Pursuant to cl. 61 of the deemed provisions of the Planning & Development (Local Planning Schemes) Regulations 2015, works undertaken to implement a subdivision are exempt from requiring development approval and therefore do not form a part of this Part 11B development application.

    Has the application changed in value?

    The application has not changed in value as a result of the changes.

    Can I comment on other aspects of the application, or just land use?

    Readvertising of the proposal is being undertaken to offer members of the public the chance to provide comment on the proposed ‘Trade Supplies’ land use, in order to contribute to the WAPC’s consideration of the development application. Whilst comments on other aspects can be made, your feedback is best limited to the additional land use only.

    Will the local government be consulted?

    Yes, the City of Busselton is being consulted as the responsible local government authority for comment on the application.

    Will my submission be shared with the City or Applicant?

    Your submission and contact information will not be published and they will not be shared with the City or applicant. A summary of the feedback from all submissions, covering the themes and key issues raised, will be shared with the City and applicant so that they have an opportunity to respond to the matters raised. A summary of submissions is included in the report presented to the WAPC for determination. To assist in its deliberations, details of all submissions are shared with Commission members on a confidential basis.

    Has the revised application been subject to design review?

    No, the revised plans have not undergone further design review. The plans advertised in December 2024-January 2025 were subject to design review. 

    The final (post-lodgement) design review report forms part of the planning report submitted to the WAPC to aid it in making a determination.

    When will this application be determined?

    Part 11B applications are required to be determined within 120 days of lodgement unless otherwise agreed between the WAPC and applicant.  

    In the case of this application, the WAPC and applicant have agreed to extend the determination period. 

    The date of the determination meeting of the WAPC’s Statutory Planning Committee (SPC) will be scheduled once the readvertising has concluded and the Department’s assessment is complete. 

    Once a meeting date is confirmed, any person who made a submission on the development application will be advised and offered the opportunity to attend the meeting either in person or online. Agenda papers will be published on the Department’s website a minimum of five business days before the meeting and interested parties can apply to make a presentation (deputation) to the SPC.

    Will I be advised about the outcome of the application?
