What is the Part 17 Significant Development Pathway?

    The Part 17 Significant Development Pathway was a temporary initiative introduced by the State Government in 2020 to encourage major developments as part of its COVID-19 pandemic economic recovery program. Applicants with proposals valued at $20 million or more in the metropolitan area and $5 million or more in regional areas were able to apply to be determined by the Western Australian Planning Commission (WAPC). In making its decision, the WAPC is able to apply additional discretion.     Why is the applicant able to apply to modify the conditions of approval?

    Under Part 17 of the Planning and Development Act 2005 applicants of approved developments are able to make an application to the WAPC amend or modify the conditions of approval.

    What amendments are proposed to the conditions of approval?

    The 17C application seeks to modify the milestones that are required to be achieved under condition 1 and to extend the permitted hours of operation under Condition 4. The application also seeks to delete conditions 11 and 12 that relate to the remediation of any soil or groundwater contamination found on site and to modify conditions 13 and 14, which relate to the decommissioning of plant. The applicant is not seeking modifications or an extension to the operational timeframe of the Concrete Batching Plant. See below:

    Condition 1 

    • The Amendment seeks to modify Condition 1 to provide further options to allow for circumstances other than where a new Batching Plant is required to be constructed, particularly where a replacement Plant involves relocation to an existing Plant where no Development Approval is required.

    Condition 4

    • The Amendment simply seeks to modify Condition 4b) to extend the hours of operation by allowing plant operations to commence at 3.00am, in lieu of 6.00am, on Mondays to Saturdays from 1 July 2025 until 31 December 2027.

     Deletion of Conditions 11 & 12

    • The applicant is seeking to delete Conditions 11 and 12 of the approval, which require the investigation and remediation of any soil and groundwater contamination within specified periods of the plant closing. 

     Modification to Conditions 13 & 14

    • Condition 13 & 14 currently requires the submission of a decommissioning plan within 6 months of the plant ceasing to operate and is to be implemented within 6 months of being approved. The applicant proposes to submit the decommissioning plan 6 months before the plant ceases to operate to allow the decommissioning to be implemented over a 12-month period. 

    Will the City of Vincent be consulted?

    Yes, consultation with the City of Vincent will occur, as the responsible local government authority for comment on the application, along with relevant State agency stakeholders.

    Will my response be shared with the City of Vincent?

    A summary of the feedback from submissions, including the themes and key issues raised, will be shared with the City of Vincent to consider in its response to the Department of Planning, Lands and Heritage (Department).

    Who will determine the amendment application and when?

    The WAPC is the decision-maker for this amendment application. A meeting date will be scheduled once feedback has been received from the public and other stakeholders, and an assessment is complete.
