The City of Mandurah (City) have proposed the excision of approximately 8000m2 of land from Class ‘A’ Reserve 27581, which is otherwise known as Hall Park, pursuant to Section 42(4) of the Land Administration Act 1997 (LAA). Reserve 27581 is set aside for the purpose of ‘Recreation Act 105-1970’ and is under the City’s management.
The proposed amendment would create a new lot, as depicted in Attachment 1, with the City to retain management of the balance of Reserve 27581. The City has proposed that the State lease them the new lot, with the City to subsequently enter a sub-lease with a commercial operator. The sub-lessee would then develop, subject to planning approvals, a brewery, chocolate retail outlet, mini golf course and café (as depicted in Attachment 2). It is also proposed to grant easements under Section 144 of the LAA over Reserve 27581, pursuant to Section 44 of the LAA, to allow the new lot to be connected to services and accessed by the public.
In accordance with Section 42(5) and 44(2), the Minister for Lands is required to give notice of the State’s intention to act in relation to Class ‘A’ Reserves, to allow public comments to be sought and considered. At the conclusion of the advertising period, the proposal may then be tabled in both Houses of Parliament of Western Australia.

The proposal was previously advertised for public comment in a different context by the City of Mandurah between 29 May 2024 and 26 July 2024. The consultation undertaken by the City was required under Section 3.59 of the Local Government Act 1995 and related specifically to the transactions the City would enter into and the financial implications for the City. The consultation did not specifically relate to the land tenure amendments under the Land Administration Act 1997.
