Frequently asked questions
Why is Operational Policy 2.2 being repealed?
The review found that most provisions in Operational Policy 2.2 Residential Subdivision either duplicate those in Operational Policy 1.1 Subdivision of Land – General Principles or are now addressed by the Residential Design Codes. A separate policy is therefore no longer required.
The remaining provisions will be incorporated into the updated Operational Policy 1.1 Subdivision of Land – General Principles, to be renamed Operational Policy Subdivision. A tracked changes version of draft OP Subdivision highlights the content being transferred from OP 2.2 for clarity. This will consolidate the requirements for residential lots with the broader subdivision requirements in a single policy. This will also help reduce duplications and make it easier to find the relevant requirements.
Do these amendments to Operational Policy 1.1 change the requirements for subdivision?
No. The amendments to Operational Policy 1.1 Subdivision of Land simply relocate the relevant provisions from Operational Policy 2.2 Residential Subdivision. No new subdivision requirements are being introduced through the new Operational Policy Subdivision.
This aligns with the State Government's commitment to ongoing legislative, regulatory and policy improvement and the development of clear and consistent guidance documents.
How are matters from Operational Policy 2.2 being addressed through the R-Codes review?
Proposed changes to the Residential Design Codes (R-Codes) are being advertised at the same time as the updated Operational Policy Subdivision. This will help readers understand how the two documents work together. The Explanatory Note highlights relevant sections of Operational Policy 2.2 to show which matters are now addressed and are open for comment through the R-Codes review.
Why is the repeal of Operational Policy 2.2 being consulted on separately to the R-Codes?
The two consultation processes are concurrent but separate. Although content from Operational Policy 2.2 (OP 2.2) is addressed in the R-Codes where a policy is proposed to be repealed, notice of this action is required. The proposed repeal of OP2.2 does not impact the status of the R-Codes.
Will I be advised about the application outcome?
If you agree to be contacted when you make your online submission, you will be notified of the outcome of this policy review process.
What are the next steps?
