Why is the applicant able to make changes to the approved plans?
As with any approved development, proponents of significant developments are able to make an application for modifications.
What is substantial commencement?
Substantial commencement means that some substantial part of work on the development has been carried out.
Why is the applicant able to apply for an extension?
Under Part 17 of the Planning and Development Act 2005 (PD Act) applicants of approved developments are able to apply for one extension of time.
When would the new substantial commencement period begin?
From the date the notice of approval is issued following the WAPC determination meeting.
Will the local government be consulted?
Yes, the Town of East Fremantle and relevant State agency stakeholders are being consulted.
Will my prior comments on the original proposal be considered as part of this amendment application?
No, this application relates to proposed changes to the approved proposal and you are advised to provide a fresh submission should you have concerns or wish to make comment about the proposed changes.
Who will determine this application and when?
The WAPC is the decision-maker for Part 17 amendment applications which require discretion under S. 171R of the PD Act. A meeting date will be scheduled once feedback has been received from the public and other stakeholders, and an assessment is complete. Should you make a submission and agree to be contacted, you will be notified of the meeting date.

If approved by the WAPC, what happens if the development is not substantially commenced by the new date?
If the development has not substantially commenced before the revised development approval period expires, the approval lapses.
